1. How do I get a key to the Common Passage Way gate?

Common Passageway Use Regulation

On November 5, 2006, the CDM Board approved the following CDM Common Passageway Use Regulation regarding access to the beach:

There are currently three (3) CDM Common Passageways:   East Passageway, Center Passageway, and West Passageway.   All three passageways have a walking gate and a larger locked gate.   The regulations are:

  1. The walking gate is never locked and is always open for access to the beach.
  2. The larger gate is always locked and requires a key to access the beach.
  3. The larger gate is restricted to transporting personal items to the beach.
  4. ATV use of the passageway is restricted to transport personal items to the beach.
  5. A key to the large gates can be checked out at the CDM Administration office.
  6. The Security Guard can unlock the large gates for a resident wanting access.
  7. Any resident who wants their own key to the large gate can obtain one from the CDM Administrator with the understanding that they agree to a $50.00 USD assessment if they violate the Common Passageway Regulations.
  8. If you lose a key, then you agree to a $50.00 USD assessment, which will be used to replace the locks and keys for the large gates.
  9. CDM residents are on their honor to NOT reproduce the gate key.


Please inform the Board if you are NOT able to access the beach using the passageway’s large gates.   The Board will look at any problems and will attempt to find a solution.

The Board is requesting that any inconvenience caused by these regulations be documented with the Board.

 


2. How do I get a CDM entry badge?

Access to CDM is restricted to CDM lot owners and their guests.   To obtain a CDM entry badge, the lot owner must go to CYBERCO Security and request an entry badge to CDM.   CYBERCO will have you fill out a form, take your picture, and verify with the CDM Administrator that you are authorized a CDM entry badge.   This process may take 1 or 2 days.   Note: CYBERCO Security is located at the bottom of the hill East of Marina Real.   About 14 K marker.


3. How do I get architecture plans approved?

CDM Projects Commission

To protect property values and to preserve the character of the community, the association’s governing documents establish architectural standards and control, and govern the use of property within the community.   You should carefully review the CDM's governing documents (Exhibits A, B, and C) to become familiar with the architectural standards for the community.   If after reviewing these documents you have specific questions, please contact the CDM Projects Commission.

Please note that this approval process takes time, and it may take up to 30 days to receive a response. We highly recommend that you do not schedule any construction work or begin any modifications before receipt of the written approval.   In the event you have construction work performed without prior written approval and the work is subsequently disapproved by the Projects Commission, it will have to be removed or modified so that it meets approval, at your expense.


4. How do I reserve the CDM Clubhouse/pool for a party?


On August 22, 2008, the CDM Board approved the following CDM Clubhouse Rules.   The Clubhouse rules are intended to establish a standard for reserving the clubhouse as well as a standard of conduct at the clubhouse.   The rules were amended on October 11, 2008 (changes are in red).

The Clubhouse Rules are:

  1. The CDM Clubhouse and pool area for parties is only for lot owners and their guests.   Lot owner may NOT reserve the clubhouse for a renter or reserve the clubhouse for its use while his/her home is rented.
  2. The CDM clubhouse may only be reserved for a party or event by a Lot Owner.
  3. Parties or events must be scheduled/reserved with the CDM Administrator (Myriam).   Lot owner must provide his/her name, lot number, and the expected number of guests.
  4. Lot owner must attend the party and must stay until the end of the event.
  5. Lot owner is responsible for the clean-up after the party
  6. Lot owner is responsible for the conduct of all guests.
  7. Lot owner is restricted to 40 or less people at the party.
  8. Lot owner must pay for an additional security person for 20 or more people (owners and guests).   The security person is arranged by the CDM Administrator (Myriam).
  9. Lot owner must pay for an additional security person if the party is on a National Holiday or the next day is a National Holiday.   The security person is arranged by the CDM Administrator.
  10. Lot owner must pay for portable bathrooms for large gatherings (20 or more).   Portable bathrooms are arranged by the CDM Administrator.
  11. The party MUST end on or before 10:00 pm on Sunday through Thursday (except when the next day is a National Holiday, see above). #1
  12. The party MUST end on or before 11:30 pm on Friday or Saturday night or when the next day is a Mexican national holiday. #1
  13. Live bands, car stereos, and concert type speakers are not allowed.
  14. Keep the volume low to respect the peace and quite of the neighborhood.   If one (1) or more CDM residents complain to the Security Guard, then the music is too loud and the volume MUST be lowered.   Complaints are anonymous.
  15. All guests must stay in the clubhouse area to ensure the privacy and security of CDM homeowners.   Guards will not allow beach access.
  16. Guest vehicles that do not have a CyberCo entry badge must park outside CDM in front of the CDM entry gate.
  17. ALL assessments (dues & special assessments) must be paid in full before the Clubhouse can be reserved
  18. A refundable deposit of 5,000 pesos is required to reserve the Clubhouse.   Deposit is to cover any damage or violation of the clubhouse rules.
  19. Non observance of the above rules is subject to the fines described in Resolution 040707. This notice is considered the warning.
  20. Note #1 – 040707, 5.8 – Disturbing the Peace will be assessed every 15 minutes the lot owner refuses to ignore the ending time.
  21. If the Lot owner does not comply with the above rules (as determined by the CDM Administrator or CDM Board member), then the permission to use the clubhouse is immediately revoked and if necessary the SC police will be called to end the party/event.

5. How do I get Internet / WiFi at CDM?

Internet access is available at CDM via WiFi.   The WiFi system has been tested and is working well.   If you are interested in having high-speed Internet access in your home, please contact X-Pro.   At this time there is not a charge for Internet access.  

Contact the CDM Administrator for the WiFi security key.


6. How do I pay my property taxes?

Property Taxes can be paid at the Guaymas Property Tax office that is located 2 doors from the San Carlos CEA office.   If you pay your property taxes in January, February, or March of each year, then you get a 10% discount.   Contact the CDM Administrator or Treasurer for your property "CLAVE" number.

There are essentially three (3) methods of paying your property taxes: 1) Pay your property taxes yourself, 2) Have a friend or neighbor or property manager pay your property taxes, or 3) Have the CDM Administration assist you in paying your property taxes.

On November 28, 2009, the CDM Board approved the following process for the CDM Administration assisting you in paying your property taxes (updated on October 14, 2012):

  1. Send an email to the CDM Administrator or Treasurer before the end of February that you would like CDM's assistance in paying your property taxes.
  2. CDM will then find-out the amount of property taxes that you owe for your lot(s). CDM will inform you of the amount by email.
  3. Send a check to CDM (payable to CDM, see Dues web page) for the amount of property taxes that you owe. There is not a convenience fee.   Extra amounts paid will be credited to your Dues account.
  4. CDM will then pay your property taxes and place the property tax receipt in your folder.   Your CDM-DB account will be charged (debit) for the amount of your proeprty tax. The property tax receipt will be mailed to you upon request.  
  5. An email will be sent to you indicating that your property taxes have been paid.

Note: CDM will only assist you in paying your property taxes if you are current with your dues and special assessments.  


7. How do I checkout recreational equipment to use?

CDM lot owners that are current with their Assessments (Dues) and Special Assessments may checkout any recreational equipment at the CDM office by exchanging their CDM CyberCo entry badge for the recreational equipment.   Lost or damaged equipment will be charged to the lot owner.


8. What are the CDM swimming pool rules?

CDM POOL RULES

  1. Pool is restricted to residents and approved renters of CDM. Guests of renters are NOT permitted.
  2. Members, their families and guests shall use the pool AT THEIR OWN RISK. THERE IS NO LIFEGUARD AT THE POOL.
  3. Children under 12 years of age must be accompanied by a responsible adult over 18.
  4. No diving allowed.
  5. No running, pushing, foul language, or general roughhousing. Please keep conduct in a manner suitable for a family environment.
  6. Place trash in receptacles.
  7. No food or drink on the pool deck. Glass is not permitted.
  8. No smoking on the premises.
  9. No loud music. Personal music devices only.
  10. Swim diapers must be worn on all toddlers.
  11. No animals, skateboards, bikes, or scooters allowed inside the fence.
  12. Appropriate swimming apparel only. No cutoffs.
  13. After being on the beach, please shower before entering the pool.

9. What are the CDM garbage bin rules?

CDM provides a common trash receptacle (garbage bin dumpster) that is located near the front gate.   Due to the additional cost to CDM, the following regulations were established by the CDM Board Directors on June 17th, 2006.   Regulation regarding trash and the use of the CDM garbage bin:

  • CONTRACTORS: Any contractor who dumps construction debris in the garbage bin will be charged a $25.00 (USD) fee for each time they use the garbage bin.
  • GARDENERS: Gardeners are required to haul their cuttings to the City dump.   Please instruct your gardener that if he dumps cuttings into the garbage bin, you the resident, will be charged a $25.00 (USD) fee.
  • RESIDENTS: Please take your garbage to the garbage bin when you leave.   If garbage is left out in the open, the Association will remove the garbage to the garbage bin and will assess a clean up charge to you.   This fee must be paid within 30 days to avoid additional penalties.

Note: GEN empties the garbage bin dumpsters on Friday and Monday.


10. What are the CDM Gate Hours?

To improve our security and help prevent theft, the following normal entry and exit hours at the CDM Gate are:


Monday       6:00 am to 11:59 pm
Tuesday       6:00 am to 11:59 pm
Wednesday   6:00 am to 11:59 pm
Thursday     6:00 am to 11:59 pm
Friday         6:00 am to 1:00 am
Saturday     6:00 am to 1:00 am
Sunday       6:00 am to 1:00 am

Normal entry and exit hours means that on entry that your CyberCo entry badge will open the entry gate and on exit the auto detect system will open the exit gate. During the NON normal hours, the guard will have to open the gate to let you enter and exit. If the guard is patrolling the neighborhood, then use the entry key pad panel to call the guard to let you enter or exit CDM.


11. What is my CDM mailing address?

Utility bills/statements may be mailed to your CDM address.   Your correspondence may be picked up at the CDM Administration Office.   Keep in mind that CDM is not responsible for lost mail.


12. What is the Protocol for Article 42 for viewing CDM records?

PROTOCOL FOR ARTICLE 42 OF THE ADMINISTRATIVE BYLAWS

Article 42 reads “Every Beneficial User or his duly appointed representative shall have the right to inspect the books and records kept in connection with the Development and to obtain, at his own expense, copies thereof for a purpose reasonably related to his interest as Beneficial User.   The Administration shall establish reasonable rules regarding the manner and time in which said inspections should be made.”

On October 11, 2008, the CDM Board of Directors approved the PROTOCOL FOR ARTICLE 42 OF THE ADMINISTRATIVE BYLAWS.     The Protocol was amended on October 18, 2008.
The protocol is:

  1. Inquiries to the CDM Administrator about your own Lot and Account may be made during normal business hours as posted at the office.
  2. CDM Lot Owners may inspect CDM records only on Saturdays between 12:00 Noon and 1:00 p.m. (by appointment only).   Financial records can be reviewed at the accountant’s office by appointment only at the owner’s expense (see #6 below).
  3. Requests for copies of public CDM document(s) must be made in writing (paper or email) to the CDM Administrator and CDM Board.
  4. CDM Lot Owner will be charged 10 pesos per page (paper) for copies of any requested public CDM documents.
  5. Personal information of other Lot Owners will NOT be divulged under any circumstances to a requesting Lot Owner or their agent.   (Note: Personal information not to be divulged includes, but is not limited to: names of family members, email address, home address, telephone number and/or fax number.)
  6. CDM bank statements, checks, or any other information with bank numbers/ information can be reviewed, but copies will NOT be given to a Lot Owner.
  7. Furthermore, in the event the CDM Administrator believes that a conversation she is having with a Lot Owner/Personal Representative, may be misinterpreted, the conversation may be recorded by the CDM Administrator.   CDM and the Board will not be bound by any statement or correspondence made by the CDM Administrator without Board approval.

For the purposes of this Protocol, the terms Beneficial User, Lot Owner, and Personal Representative are synonymous.


13. What are the rules to rent your house?


14. What are the responsibilities of the CDM Board, Administrator, Security, and Maintenance personnel?

CDM Board of Directors:
The CDM Board of Directors bears the ultimate responsibility for operating your homeowner association.   Board members are elected for a one year period by the association’s membership.   The CDM Board of Directors is empowered and directed to carry out the following duties:

  • Prepare the annual budget for the association.
  • Collect all assessments due the association.
  • Provide for the necessary operating personnel by directly hiring personnel and/or contracting, solicitation of volunteers, etc.
  • Enforce all provisions of the governing documents.
  • Provide for the care and maintenance, and replacement of common areas or improvements.
  • Perform all duties necessary for the association’s administration.
  • Respect the definitions provided and the limitations of authority set forth in the governing documents.

Being a member of the Board of Directors is a big job.   It requires a sincere commitment; a clear understanding of the association’s governing documents and the association’s future needs, and a desire to provide a high quality of life for all residents.   Furthermore, all members of the Board are volunteers and serve without compensation from your association.   It is important that you give your Board of Directors your support and cooperation.   Additionally, as a member of a homeowner’s association, it is your privilege and responsibility to assist in its governance.
The CDM Board of Directors duties are:

President’s Duties – Include, but are not limited to the following:

  • The President shall have executive powers and responsibility for general supervision over the affairs of the CDM Homeowners Association, including but not limited to the power to appoint committees from among the lot owners to assist in the conduct of the affairs of the Association.
  • The President shall attend CDM Homeowners Association meetings in April and October in San Carlos and attend other special meetings and Board meetings as necessary.
  • The President is a non-voting member of the CDM Board of Directors.   The president only votes in the case of a tie vote.

 

Vice President’s Duties – Include, but are not limited to the following:

  • The Vice President shall take the place of the President and perform all of the duties of the President whenever the President is absent or unable to act.
  • The Vice President shall perform other duties as may be imposed on the Vice President from time to time.
  • The Vice President shall attend CDM Homeowners Association meetings in April and October in San Carlos and attend other special meetings and Board meetings as necessary.
  • The Vice President is a voting member of the CDM Board of Directors.

 

Treasurer’s Duties – Include, but are not limited to the following:

  • The Treasurer shall be responsible for overseeing the books of CDM including income and expenses.   All books of account shall be kept on a consistent basis in accordance with generally accepted accounting practices.
  • The Treasurer shall provide a budget for lot owners’ approval at the end of the fiscal year for the following year.
  • The Treasurer shall liaise with the CDM Administrator on financial issues, as necessary.
  • The Treasurer shall supervise the collection of delinquent assessments.
  • The Treasurer may delegate the collection, deposit, and disbursement of monies by establishing a reasonable method of accounting which may be reviewed by the Board on a monthly basis.
  • The Treasurer shall also perform such other duties as may be imposed on the Treasurer from time to time by the Board.
  • The Treasurer shall attend CDM Homeowners Association meetings in April and October in San Carlos and attend other special meetings and Board meetings as necessary.
  • The Treasurer is a voting member of the CDM Board of Directors.

 

Secretary’s Duties – Include, but are not limited to the following:

  • The Secretary shall be responsible for taking minutes at all homeowners meetings and Board meetings and providing the finalized minutes for distribution within two weeks of the meeting.
  • The Secretary shall assist with the CDM newsletter.
  • The Secretary shall also perform such other duties as may be imposed on the Secretary from time to time by the Board.
  • The Secretary shall attend CDM Homeowners Association meetings in April and October in San Carlos and attend other special meetings and Board meetings as necessary.
  • The Secretary is a voting member of the CDM Board of Directors.

 

Director of Governmental and Legal Affairs (Director) Duties – include, but are not limited to the following:

  • The Director shall negotiates formal agreements with government authorities for funding and cooperation in maintaining our streets, lights water and sewer system.
  • The Director shall obtain legal opinions when required.
  • The Director shall respond to legal and Governmental questions.
  • The Director shall represent the Association in legal matters.
  • The Director shall supervise and maintain all the required documents and filings with the governmental entities.
  • The Director of Governmental and Legal Affairs is a voting member of the CDM Board of Directors.

 

Election Committee (Special Committee):

  • The Election Committee consists of two (2) or more Beneficial User volunteers.
  • At least one member of the Election Committee must NOT be a member of the Administration (CDM Board).
  • The Election Committee volunteers serve for the month prior to the CDM meeting, during the CDM meeting, and approximately one month after the CDM meeting.
  • The Election Committee (Article 30, “Examiners”) certifies in writing that quorum requirements are met. Personal votes, proxy votes, & absentee ballot votes count toward the quorum (Article 29, 30, and 31).
  • All completed ballots are emailed/mailed to the election committee. The Election Committee enters your votes in a tally spreadsheet.
  • The Election Committee will confirm receipt of absentee ballots by emailing back to the voter.
  • The Election Committee certifies quorum requirements, all votes, and vote totals for the meeting minutes.

 

CDM Personnel Responsibilities and Duties

 

Administrator – Duties include, but are not limited to the following:

  • The Administrator shall be responsible for the management of CDM personnel
  • The Administrator shall maintains CDM financial records
  • The Administrator shall be responsible for petty cash
  • The Administrator shall be responsible for Day-to-day oversight of the CDM development
  • The Administrator shall liaise with construction company personnel as necessary to ensure CDM rules and regulations are being followed
  • The Administrator shall be responsible for contacting lot owners as necessary to clean up their lots
  • The Administrator shall attend CDM Homeowners Association meetings in April and October in San Carlos and attend other special meetings and Board meetings as necessary.
  • The Administrator shall also perform other duties as assigned by the Board

 

Maintenance/Grounds Personnel (contracted)– Include, but are not limited to the following:

  • Maintain the sewer pump lift station
  • Maintain the CDM common area
  • Make minor repairs of CDM equipment
  • Report to the Administrator anything out of the ordinary, i.e. water leaks
  • Perform duties as assigned by the Administrator

 

Security Guards (contracted) – Include, but are not limited to the following:

  • Provide 24 x 7 security at the CDM gate
  • Security Guard may roam the CDM area from time to time
  • Security Guards shall perform all activities agreed to in the contract between CDM and their company
